This section is where most Terms documents become hostile. We are going to keep the substance that reasonable courts expect of any consumer service, and skip the parts that try to strip you of legal rights you should keep.
The Service is provided as-is
Kythen is provided "as is" and "as available." We do not promise the Service will be uninterrupted, bug-free, or available in all places at all times. We work hard to keep it reliable, but we do not guarantee perfection.
We are not responsible for what other users do
Kythen connects verified users at verified venues. We do not screen conversations in real time. We do not supervise what you and another user decide to do after you connect. Kythen is not liable for the offline conduct of other users, including outcomes of meetings arranged through the Service.
This is not us disclaiming responsibility for our own conduct. It is us recognizing the limit of what any platform can control. Our own obligations, which we take seriously, are about running the platform carefully, responding to reports, and enforcing the standards in these terms and on the Safety page.
We are not responsible for venue conduct
Venues on Kythen are verified, but they are independent businesses. Kythen is not liable for the conduct of a venue, its staff, or events run by hosts at a venue. If a venue consistently fails the standard users expect, the venue loses verification and is removed.
Limit of our financial liability
To the extent permitted by law, our total liability to you for any claim arising out of the Service is limited to the amount you have paid Kythen in the twelve months preceding the claim, or one hundred U.S. dollars, whichever is greater. We do not use this provision to evade genuine responsibility; it exists because any platform providing services at scale needs a bounded liability framework. Some jurisdictions do not allow such limits, and this limit does not apply where prohibited.
What this section does not do
These disclaimers and limits do not apply to our own intentional misconduct, our gross negligence, or to liabilities that cannot be excluded by law (for example, certain consumer protections in the European Union, or specific state laws in the United States). We are not using this section to escape being responsible for what we do, only to describe the edge of what any platform can be responsible for.
