What we offer, what you agree to, what we promise not to do. The short version is at the top.

Pre-launch draft. These terms are under final legal review and will be formalized by counsel before Kythen launches. The substance here will not change, the specific legal language may be refined for compliance and clarity.

In short

The two-minute version.

Kythen is an app that helps verified users meet in verified rooms. You agree to be honest about who you are, to treat other users with basic decency, and to use Kythen for its intended purpose. We agree to run the platform carefully, respect the commitments we made in our Privacy policy, and treat you fairly.

You must be eighteen or older to use Kythen. You keep ownership of what you post. We take only the minimum license we need to operate the service, and the license ends when you delete your content or your account.

If you subscribe, you can cancel anytime. Cancellation takes effect at the end of the current billing period. Refunds are pro-rated where required by law and handled quickly. No hoops.

We will not change these terms without telling you. Material changes are announced at least thirty days in advance, with the option to delete your account before the change applies.

If we have a dispute, we handle it like adults. No forced arbitration, no class-action waiver, no attempt to strip you of legal rights you would otherwise have. Specific jurisdiction and process are named below.

Some things are on you, not us. Kythen can do a lot to make the platform safe, but we cannot follow you out of the venue. What happens offline, after the app ends, is between you and the people you chose to meet. Use good judgment. Kythen is a tool, not a guarantor.

The full agreement is below. It is the version we expect counsel to finalize, and the version you are agreeing to when you use Kythen.

i.

Who we are, what we offer.

Kythen is provided by Kythen LLC ("Kythen," "we," "us"). The Kythen mobile application and the Kythen website at kythen.place (together, "the Service") let verified users be present in verified rooms, meet the people who are there, and see patterns of shared presence over time.

By creating an account, using the Service, or clicking "I agree" when presented with these terms, you ("you," "the user") enter into this agreement with us. If you do not agree, do not use the Service.

These terms apply to all users of Kythen. Venues have a separate commercial agreement with us; if you operate a venue on Kythen, the Venues page describes the additional terms that apply to you in that role.

ii.

Eligibility and your account.

Age

You must be at least eighteen years old to use Kythen. If we learn that a user is under eighteen, we will close the account. We do not operate a version of Kythen for minors.

Verification

Some features on Kythen require identity verification. Verification is voluntary, but certain safety and discovery features are available only to verified users. When you verify, you are representing that the information you provide is truthful and current.

One account per person

You may have one Kythen account at a time. Creating multiple accounts to evade a ban, to impersonate others, or to circumvent platform limits violates these terms.

Your responsibility for your account

You are responsible for keeping your login credentials secure and for activity on your account. Tell us immediately if you believe your account has been accessed without your permission.

Your use of Kythen.

What Kythen is for

Kythen is for meeting people at verified venues, connecting with those you meet, and exchanging messages. You may use the Service for its intended purpose, in the ordinary course of your social life.

What is not allowed

The following conduct on Kythen is prohibited. Any of it is grounds for account suspension or termination, and in some cases, referral to law enforcement:

  • Harassment, stalking, or threats against any other user.
  • Hate speech, or content that promotes violence against any group based on identity.
  • Sexual content involving minors, of any kind, in any form. This is also a matter for law enforcement.
  • Impersonation of another person, or misrepresentation of your verified identity.
  • Commercial spam or solicitation not permitted by the venue or event.
  • Attempting to game presence verification, such as sharing QR codes or sessions with people not present at the venue.
  • Scraping, automated data collection, or circumventing our technical measures.
  • Using Kythen to plan or facilitate illegal activity, including the sale of controlled substances.
  • Creating fake accounts, coordinating inauthentic behavior, or manipulating the platform's safety or discovery mechanisms.

Reporting and moderation

If you experience or witness behavior that violates these terms, report it through the app or to trust@kythen.place. We respond within the timelines described on the Safety page.

Your offline conduct

Kythen exists to help you meet people in real venues. What happens between you and other users outside the Service, whether at the venue or afterward, is between the parties. We take safety seriously within the platform, but we do not and cannot supervise interactions outside it. Use your own judgment. The rest of this document includes specific provisions about what Kythen is and is not responsible for.

iv.

Your content.

Content you contribute to Kythen includes your profile (display name, photos, age, other information you add), your messages to other users, and any material you submit in reports or feedback.

Ownership

You keep ownership of your content. Submitting content to Kythen does not transfer ownership to us.

The license you grant us

You grant Kythen a limited, non-exclusive, royalty-free license to use, store, display, and transmit your content solely to operate the Service on your behalf. This license exists so we can legally deliver your message to the person you sent it to, display your profile to other users you are connected with, and store your content while your account exists. The license ends when you delete the content or your account. We do not claim a broad or perpetual license to use your content for other purposes.

Content that breaks the rules

Content that violates these terms, our Safety standards, or applicable law may be removed. Users may be warned, suspended, or banned. Patterns of serious violation, or single violations of particular severity, result in permanent account termination.

Feedback

If you send us suggestions or feedback about the product, you grant us a perpetual, royalty-free license to use that feedback to improve the Service. Feedback is separate from content.

Subscriptions and payment.

Paid features

Kythen is free to use at its core. Some features require a paid subscription. The price, billing cycle, and what the subscription includes are disclosed before you subscribe. You agree to the specific price in effect when you subscribe.

Billing

Subscriptions renew automatically at the end of each billing period, at the then-current price. You can cancel anytime.

Cancellation

Cancellation takes effect at the end of your current billing period. You keep access to paid features until then. You are not charged again after cancellation unless you resubscribe. There are no hoops: cancellation happens from your account settings in one or two taps, without us asking you to call someone, write an explanation, or confirm multiple times.

Refunds

If you believe you are entitled to a refund, write to billing@kythen.place. We handle refund requests quickly and fairly, and we comply with any legal requirements in your jurisdiction (for example, EU consumer law, or specific state laws in the United States).

Price changes

If we change the price of a subscription tier, existing subscribers are notified at least thirty days before the change takes effect. Subscribers locked into an early-subscriber price ("Founding Member" rates, or similar) keep their original price per the terms of that commitment, unless they voluntarily upgrade or cancel.

No card collection without a subscription

We do not collect payment information except when you are actively subscribing to a paid tier. We do not keep cards "on file" speculatively.

vi.

Venues.

If you operate a venue on Kythen, additional terms apply to that role. Those terms are presented during venue onboarding and are a separate agreement between the venue and Kythen LLC. Nothing in this document replaces or modifies that agreement.

As a user, when you visit a venue on Kythen, you are in a space operated by that venue. The venue is responsible for its own conduct, staff, premises, and compliance with local law. Kythen provides the platform that connects you to the venue; we do not operate the venue.

vii.

Ending your account.

Leaving on your own terms

You can delete your Kythen account anytime, from within the app. Deletion is permanent. Your data is removed per the schedule in our Privacy policy. Some records (past moderation reports, legal audit records, tax records for paid subscribers) are retained for the periods named there.

When we end an account

We may suspend or terminate an account for serious or repeated violations of these terms, for violations of the Safety standards, or where required by law. In most cases we attempt a warning first, but some violations (threats, content involving minors, coordinated abuse) result in immediate termination.

We will tell you why. If your account is suspended or terminated, we notify you with a clear explanation of the specific reason. You may appeal by writing to appeals@kythen.place. A different moderator than the one who made the original decision reviews your appeal.

What survives termination

After account termination, the following parts of this agreement continue to apply: the content license you granted us (to the extent needed to operate the Service for other users during the retention window), disclaimers, limits of liability, and dispute resolution. The rest ends when your account ends.

Disclaimers and limits.

This section is where most Terms documents become hostile. We are going to keep the substance that reasonable courts expect of any consumer service, and skip the parts that try to strip you of legal rights you should keep.

The Service is provided as-is

Kythen is provided "as is" and "as available." We do not promise the Service will be uninterrupted, bug-free, or available in all places at all times. We work hard to keep it reliable, but we do not guarantee perfection.

We are not responsible for what other users do

Kythen connects verified users at verified venues. We do not screen conversations in real time. We do not supervise what you and another user decide to do after you connect. Kythen is not liable for the offline conduct of other users, including outcomes of meetings arranged through the Service.

This is not us disclaiming responsibility for our own conduct. It is us recognizing the limit of what any platform can control. Our own obligations, which we take seriously, are about running the platform carefully, responding to reports, and enforcing the standards in these terms and on the Safety page.

We are not responsible for venue conduct

Venues on Kythen are verified, but they are independent businesses. Kythen is not liable for the conduct of a venue, its staff, or events run by hosts at a venue. If a venue consistently fails the standard users expect, the venue loses verification and is removed.

Limit of our financial liability

To the extent permitted by law, our total liability to you for any claim arising out of the Service is limited to the amount you have paid Kythen in the twelve months preceding the claim, or one hundred U.S. dollars, whichever is greater. We do not use this provision to evade genuine responsibility; it exists because any platform providing services at scale needs a bounded liability framework. Some jurisdictions do not allow such limits, and this limit does not apply where prohibited.

What this section does not do

These disclaimers and limits do not apply to our own intentional misconduct, our gross negligence, or to liabilities that cannot be excluded by law (for example, certain consumer protections in the European Union, or specific state laws in the United States). We are not using this section to escape being responsible for what we do, only to describe the edge of what any platform can be responsible for.

Disputes.

Informal resolution first

If you have a dispute with Kythen, the quickest path is usually to write to us. Most issues resolve in a single exchange. Use legal@kythen.place for anything that feels like it needs a formal response.

No forced arbitration

Important difference from most terms
We do not require you to waive your right to sue us in court. We do not include a mandatory arbitration clause. If informal resolution fails, you have the legal rights you would ordinarily have as a consumer in your jurisdiction. This is the opposite of the standard template used by most consumer services. It is a deliberate choice.

No class-action waiver

We do not ask you to waive your right to participate in a class action. We believe a consumer service that treats users well should not be afraid of class-level accountability.

Governing law and jurisdiction

These terms are governed by the laws of the State of Wyoming in the United States, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved informally may be brought in a court of competent jurisdiction, including courts in Wyoming. If you are a consumer in the European Union, the United Kingdom, or another jurisdiction with specific consumer-protection rules, the mandatory protections of your jurisdiction apply in addition to this agreement.

Changes to these terms.

We may update these terms from time to time. When we do, we are transparent about it.

  • Minor edits that do not change the substance of the agreement are noted by updating the date at the top of this page.
  • Material changes (meaningful changes to what we offer, to your rights, or to our obligations) are communicated to you in the app and by email at least thirty days before they take effect. During that thirty-day window you can delete your account, and the material change will not apply to you retroactively.
  • We do not use dark patterns to obtain consent for changes. We will not bury material changes in unrelated notifications. We will not condition continued use of the Service on accepting changes you have not seen.

xi.

Miscellaneous.

Entire agreement

These terms, together with our Privacy policy, make up the full agreement between you and Kythen regarding your use of the Service. They replace any earlier agreements on the same subject.

Severability

If any part of these terms is found to be unenforceable by a court, the rest of the terms remain in effect. The unenforceable part is interpreted to reflect its original intent to the extent the law allows.

No waiver

If we do not enforce a particular right under these terms immediately, that does not mean we have waived it. We can enforce it later.

Assignment

You may not transfer your rights or obligations under these terms without our written consent. We may assign these terms as part of an acquisition, corporate restructuring, or similar event. In that case, any commitments made in these terms or in our Privacy policy transfer to the new entity.

Relationship

Nothing in these terms creates a partnership, joint venture, employment, or agency relationship between you and Kythen. You are a user of the Service.
